2. Description of Service

GirschWorks Digital provides managed website services, including website design, hosting, a content management system, client portal access, analytics, form management, document handling, and related tools for businesses. The specific features available to you depend on your service plan.

3. Account Registration

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your password and account credentials.
• Accept responsibility for all activities that occur under your account.
• Notify us immediately of any unauthorized use of your account.

4. SMS/Text Messaging Terms

By providing your phone number during account registration, you consent to receive SMS messages from GirschWorks Digital for the following purposes:

• Account Verification: One-time passcodes to verify your identity during account setup.
• Account Notifications: Alerts about account activity including new signups, document signatures, and payment updates.

5. Payment Terms

Fees for our services are outlined in your service agreement. Payments are processed through Stripe. You agree to pay all fees associated with your plan. Failure to pay may result in suspension or termination of your account. Refunds are handled on a case-by-case basis.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Upload malicious code, viruses, or harmful content.
• Attempt to gain unauthorized access to any part of the Service.
• Interfere with or disrupt the Service or servers.
• Use the Service to send spam or unsolicited communications.
• Resell or redistribute the Service without written consent.

7. Intellectual Property

The Service, including its design, features, and technology, is owned by GirschWorks Digital and protected by intellectual property laws. You retain ownership of the content you upload to the platform. By uploading content, you grant us a limited license to host, display, and distribute that content solely for the purpose of providing the Service.

8. Hosting and Uptime

We strive to maintain high availability of the Service but do not guarantee 100% uptime. We are not liable for any downtime, data loss, or service interruptions caused by factors beyond our reasonable control, including third-party service outages, natural disasters, or network issues.

9. Limitation of Liability

To the fullest extent permitted by law, GirschWorks Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Termination

Either party may terminate the service relationship at any time. Upon termination, your access to the platform will be revoked. We will provide a reasonable period to export your data upon request. We reserve the right to suspend or terminate accounts that violate these terms.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
